Di Pietro, cioè Belotti, fa reclamo al Consiglio di Stato. All’udienza dell’11 gennaio 2005, però, non si presenta nessuno: né l’Inail né la Scip e nemmeno la Bergamo House. Persino l’Avvocatura dello Stato ritiene di non doversi costituire. Al giudice del reclamo non resta che accogliere la domanda di Belotti (cioè di Di Pietro) domanda che però - stando all’articolo 81 del codice di rito - andava rigettata qualora il giudice fosse stato informato che il vero compratore era un soggetto terzo con incarichi pubblici. L’articolo 1471 del codice civile è chiaro sul punto: «Non possono essere compratori, nemmeno all’asta pubblica, né direttamente né per interposta persona, gli amministratori dei beni dello Stato».
E ancora. Al momento di stipulare l’atto d’acquisto, il prestanome sparisce e compare finalmente Di Pietro con cinque assegni. Anche qui il notaio avrebbe dovuto rilevare che nel verbale di aggiudicazione risultava Belotti, il quale aveva costantemente reiterato il suo interesse personale all’acquisto agendo a nome proprio, e non per conto di Di Pietro, che ai sensi di legge non avrebbe nemmeno potuto farlo. In più, per attribuire la proprietà all’ex pm, il notaio avrebbe dovuto compiere due distinti atti (uno di aggiudicazione dell’immobile tra SCIP-Inail and Belotti, another trading between Belotti and Di Pietro).
